ADMINISTRATIVE ORDER NO. 150
Under the authority of art. III, secs. 1 and 24 of the Alaska
Constitution and AS 37.07.010, I, Walter J. Hickel, Governor
of the State of Alaska, establish the 40-hour normal work week
for most executive branch employees in the exempt service of
state government under AS 39.25.110. This policy is being formally
established in the interests of economy and efficiency and in
keeping with sound administrative principles and practices for
the executive branch.
POLICY FOR 40-HOUR NORMAL WORK WEEK
FOR EXEMPT EMPLOYEES IN THE EXECUTIVE BRANCH
It is the policy of the executive branch of state government
that employees in the exempt service under AS 39.25.110 have
a minimum 40-hour normal work week with exceptions for state
holidays. This policy extends to those state employees in the
executive branch in the exempt service under AS 39.25.110, except
for those employees who are members of a collective bargaining
unit established under AS 23.40.070 - 23.40.260 (Public Employment
Relations Act) or who are employees occupying positions described
in AS 39.25.110(5) or (24).
This policy does not establish a maximum number of hours to
the affected employees' work week. For employees who are exempt
from the overtime provisions of 29 U.S.C. 201 - 219 (Fair Labor
Standards Act), this policy does not authorize any deductions
from the employees' predetermined compensation that are not authorized
for employees paid on a salary basis under the Fair Labor Standards
Act. Employees compensated on a salary basis will continue to
be compensated on that basis as required under the Fair Labor
Standards Act. Any deductions from the predetermined compensation
of these employees must be made in accordance with the Fair Labor
Standards Act and the rules adopted under the Act.
POLICY EFFECTIVE UPON LEGISLATIVE
OR OTHER APPROVAL OF SALARY ADJUSTMENTS
The policy contained in this Order takes effect only upon
approval by the legislature or other appropriate authority for
salary adjustments proportional to the additional 2.5 hours to
the normal work week for employees affected by this Order.
This Order takes effect immediately.
