I, Steve Cowper, Governor of the State of Alaska, under the authority granted by Article III of the Alaska constitution and by Alaska Statute 44.17.060, hereby establish the Job Training Council (council). The council will be appointed by the Governor to serve as the State Job Training Coordinating Council 1/ under the Job Training Partnership Act (JTPA) of 1982 (P.L. 97-300), as amended.

By this order, I am amending Administrative Order No. 74, by Administrative Order No. 113 2/ (as amended).

1/ Formerly known as the Alaska Job Training Coordinating Council, as established by Administrative Order No. 74, signed March 24, 1983 and amended by Administrative Order No. 113.

2/ Administrative Order No. 113 outlines the State employment and training policy and establishes an Employment and Training Mini-Cabinet in the Executive branch.

1. The purpose of the council is to facilitate training and employment opportunities for individuals with serious barriers to employment: the economically disadvantaged, people dislocated from employment including older workers, disabled individuals, and youth at risk of economic disfranchisement due to educational deficiencies.

2. The purpose of the council will be realized through the following means: (1) identifying the employment and training needs of the state; (2) coordinating, monitoring and evaluating local, state, and federal programs; (3) minimizing the duplication of services so that people of Alaska are ensured consistent, integrated training and employment opportunities. The council shall advise the Governor and the Employment and Training Mini-Cabinet on issues related to its mission and purpose. The council shall perform all functions prescribed in Section 122(b) of the Act in addition to any other employment and training tasks assigned to it by the executive branch of Alaska State government.

3. The council is composed of at least 20 members who reasonably represent the population of the state. The Governor may designate other cabinet level or executive office officials, in addition to those specified as full voting members on page two, section b(2) , to serve as ex-officio members of the council without voting privileges. Members of the council serve for staggered terms of three years at the pleasure of the Governor. However, in the initial appointment of members to the council, a term may be less than three years, so that the term of approximately one-third of the council expires each year. The terms of legislative appointments are concurrent with their terms in office.

Council membership is prescribed in Section 122 (a) (3) of the Act and shall be met through the following appointments:

a. Six seats are assigned to representatives of business and industry who are owners of business concerns, or chief executives or chief operating officers from business or industry. At least half of the business and industry members will be chosen from business concerns that employ 100 or more people. General purpose business organizations will be encouraged to nominate candidates for business and industry appointments.

b. Eight seats are assigned to members of state and local government agencies, including representatives of the state legislature, and local education agencies.

(1) Each house in the Alaska State Legislature shall have a seat on the council.

(2) The commissioners, or designees, of the departments of community and regional affairs, health and social services, and labor, will each have a seat on the council.

(3) One seat shall be for postsecondary school representation with candidates from or nominated by the Alaska Commission on Postsecondary Education, or the University of Alaska's College of Career and Vocational Education.

(4) Two seats shall be for representatives of units of local government, representatives of local educational agencies, or representatives of agencies serving an advocacy role in education.

c. Six seats are assigned to representatives of organized labor and representatives of community-based organizations as defined in Section 4(5) of the Act. Each of these two groups within this category will have three seats.

d. Two seats are assigned to individuals from the general public having a demonstrated interest in employment or vocational training issues.

4. The Governor will designate one non-governmental member to serve as chairman of the council. The council may adopt by-laws, elect other officers, and establish standing committees as it considers appropriate.

a. The council shall meet as necessary. Meetings of the council must be open to the public and must be preceded by reasonable public notice.

b. A quorum of the full council consists of one more than one-half of the membership. The legislative seats need not be counted in determining a quorum.

c. Members of the council are not entitled to receive compensation for service on the council, but are entitled to per diem and travel expenses authorized by law for boards and commissions.

5. The Department of Community and Regional Affairs shall provide professional, technical, and clerical staff assistance to support the activities of the council.

The Department of. Community and Regional Affairs is responsible for general statewide implementation, administration, compliance, and fiscal oversight of all JTPA programs, except for those specific responsibilities relating to the Act that are assigned to other state or federal agencies.

The Department of Labor shall serve as the state agency responsible for management and oversight of a statewide comprehensive labor market and occupational supply and demand information system.

Persons serving on the former state job training coordinating council shall continue to serve on the Job Training Council for the duration of their existing term. New appointments or reappointments to the council will occur as each respective term expires.

I find that the establishment of the council will further promote and enhance employment opportunities for residents of the state.

This Order takes effect on the 23rd day of August , 1990
