ADMINISTRATIVE ORDER NO. 34
Under the authority of Article III, Section I of the Constitution
of the State of Alaska and AS 44.19.025, I hereby establish the
Highway Safety Planning Agency within the Department of Public
Safety.
Creation of the Highway Safety Planning Agency is necessary
because AS 44.10.025 has authorized and directed the Governor
to do all things necessary on behalf of the State to secure the
full benefits of the Federal Highway Safety Act of 1966, (P.L.
89564, 80 Stat. 731) to improve the highway safety of the State.
Furthermore, AS 44.19.025 has designated the Governor as the
official ultimately responsible for the highway safety programs
pursuant to the Highway Safety Act of 1966 and authorized and
directed him to coordinate the activities of any and all departments
and agencies in the State and its sub-divisions for such purpose.
The Highway Safety Planning Agency is therefore necessary to
establish a formal organization and delegate thereto certain
of the Governor's powers and authority for the execution of highway
safety programs pursuant to the Highway Safety Act of 1966.
The Highway Safety Planning Agency is established as follows:
1. The Agency shall be within the Department of Public Safety,
headed by a director and shall be staffed by such other officers
and employees as said director may from time to time appoint
according to law.
2. The director of the Highway Safety Planning Agency shall
possess all powers and authority necessary to carry out the responsibilities
entrusted to the Governor by AS 44.19.025, and the director is
hereby authorized to exercise such power and authority in complying
with the intent of AS 44.19.025. The powers and authority hereby
delegated to the director may be redelegated within the Highway
Safety Planning Agency.
3. All departments and agencies within the Executive Branch
of the State government shall cooperate with the director of
the Highway Safety Planning Agency in the performance of the
director's highway safety functions provided herein to the full
extent permitted by law.
This Order takes effect on September 1, 1976.
