ADMINISTRATIVE ORDER NO. 5
WHEREAS, the Departments of Law and Labor have reported that
there exists a pattern of willful noncompliance with the state
local autonomy statute AS 23.40.050 and the regulations and policies
of the State with respect to local autonomy of labor organizations;
and
WHEREAS, it would be contrary to the public interest to permit
persons or organizations in violation of the laws, regulations
and policies of the State, to benefit directly or indirectly
from contracts with the State of Alaska or involving public funds
of the State;
NOW, THEREFORE, by virtue of the authority vested in me as
Governor, I hereby order the following:
1. All future contracts made, entered into or approved by
the State or any office or agency thereof, shall include the
following provision on local autonomy and non-discrimination
against local residents which all contractors shall be required
to accept as a condition of being awarded such contract:
"The contractor agrees that he will not enter into any
contracts or labor agreements with, nor will he accept any dispatch
or referral of employees from, any labor or other organization
which is not in compliance with the state local autonomy law
(AS
23.40.050) and all state regulations made pursuant thereto, nor
will the contractor enter into any contract or labor agreement
with, or accept any dispatch or referral of employees from, any
organization, individual or union which has been found by the
Department of Labor or other duly authorized officer or agency
of the state government to have 100 or more members in good standing
who reside or work in Alaska but not to have one or more duly
chartered and established local organizations in this state,
or to have practiced employment discrimination against local
residents.
"Contractor further agrees that he will require this
provision to be inserted in any and all other contracts, subcontracts
or labor agreements entered into by the contractor and to be
performed in whole or in part within the State of Alaska.
"Contractor further agrees that he will not himself discriminate
against Alaska residents with respect to opportunities, conditions
or tenure of employment under this contract or under any contract
to which contractor is a party and which is to be performed in
whole or in part within the State of Alaska.
"Noncompliance with any portion of these provisions shall
be deemed a breach of this contract and cause for termination
and revocation of the contractor's authorization to bid on future
contracts with the State of Alaska if not corrected within 10
days after written notice is given to the contractor by the state
or an office or agency thereof."
This Order takes effect immediately.
